1. The service and provider

SMkino is a cloud-based marketing service (SaaS) for cinemas. It is provided by Chavez Konsult Sergio Arturo Chavez Rosales (sole proprietorship), Norwegian organisation no. 923 941 010, registered in the Norwegian Central Coordinating Register for Legal Entities (Enhetsregisteret), trading as Optimaized. Its business address is Brennrud 19, 2500 Tynset, Norway. The service generates, manages and publishes social-media content based on the cinema's film programme.

2. Contractual relationship

By creating an account and using SMkino, you enter into a service agreement with Chavez Konsult on behalf of your cinema. These terms apply until the service agreement ends, including use of the Free plan. The person accepting on behalf of the cinema must be authorised to do so.

3. Access and use

• The service is available to authorised employees of cinemas with a valid DX Cinema integration.
• Each cinema receives an isolated account. Data is not shared between cinemas.
• You are responsible for keeping sign-in details confidential.

4. AI-generated content

• SMkino uses artificial intelligence to generate marketing suggestions.
• The cinema chooses between manual review and approval before publication and automated routines expressly enabled by an authorised operator. An automated routine may publish posts without individual review. The cinema must check its instructions, channels and publishing rules before activation, monitor results and stop the routine when errors occur.
• The cinema is responsible for lawful content and automation instructions, accurate film, price and availability information, and the necessary rights to text, images and other material. AI suggestions may contain errors.
• The cinema retains the rights to its own content processed through the service.
• The provider is not liable for content published without sufficient review.

5. Trial period and subscription

• Free trial: 15 days with full access. No credit card required.
• Pro (NOK 790/month): AI generation for Facebook and Instagram, historical forecasts, results dashboard and Meta Insights.
• Enterprise (NOK 1,490/month): Everything in Pro, plus real-time data, post-analysis, API access and priority support.
• Prices exclude VAT and are billed monthly through Stripe.

6. Cancellation

• You may cancel the paid subscription at any time through settings or by email. Paid access continues for the remainder of the billing period; the cinema then moves to Free and its data remains available under that plan.
• Cancelling payment does not terminate the service agreement. To end the agreement, use Settings → Privacy → Terminate agreement or contact us. Personal data processed on the cinema's behalf is deleted within 30 days of termination, unless law requires retention. The cinema may choose to receive an export before deletion.

7. Uptime and availability

We aim for 99.5% uptime but provide no guarantee. Planned maintenance is announced in advance. The subscription may be credited proportionally in the event of prolonged unavailability.

8. Data processing

For the cinema's content, operator messages, integrations and operational data, the cinema is the controller and Chavez Konsult is the processor. For accounts, contracts, billing and security, Chavez Konsult is an independent controller. See the privacy policy and data processing agreement.

9. Limitation of liability

• The service is provided “as is” without a guarantee as to the accuracy of AI-generated content.
• The provider's maximum liability is limited to the amount paid for the service during the previous 12 months.
• The provider is not liable for the availability of third-party platforms, including Meta, Snapchat, TikTok and DX.

10. Changes

We may amend these terms. Material changes will be notified by email at least 30 days before they take effect.

This version applies to new agreements entered into under version 2026-09-06 and clarifies cancellation, acceptance and manual or automated approval settings. The existing 12-month liability limit is unchanged. For existing customers, any material amendment takes effect only after the notice required by section 10; publication alone does not shorten that period or establish acceptance.

11. Disputes

These terms are governed by Norwegian law. The parties will attempt to resolve disputes amicably before any legal proceedings at Oslo District Court.
